By accessing and using Albumus ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
Albumus is a Software-as-a-Service (SaaS) platform that uses artificial intelligence to generate personalized image albums from user-uploaded photographs. The Service transforms user photos into various artistic styles and themes based on user selections.
Important: AI image generation is probabilistic in nature. Results may vary and are not guaranteed to be identical across multiple generations, even with the same input. The Service uses advanced AI models that may produce different outputs for similar inputs.
You are responsible for:
You retain all rights to the photographs and content you upload to Albumus. By uploading content, you grant Albumus a limited, non-exclusive license to use, process, and store your content solely for the purpose of providing the Service and generating your requested albums.
You represent and warrant that you own or have the necessary rights to all content you upload, and that such content does not infringe upon any third-party rights, including intellectual property, privacy, or publicity rights.
Upon completion of payment and generation, you own the AI-generated images created for you. You may use these images for personal or commercial purposes, subject to the restrictions in Section 6.
Albumus retains the right to use generated images for service improvement, quality assurance, and promotional purposes (with user consent where required by law).
You agree not to use the Service to:
All payments are processed through Stripe, a third-party payment processor. Albumus does not store or have access to your complete credit card information.
Due to the nature of AI generation and the immediate costs incurred upon generation, all sales are final. Refunds may be provided only in cases of technical failures where no images were generated, at Albumus's sole discretion.
Albumus reserves the right to modify, suspend, or discontinue the Service at any time without prior notice. We do not guarantee that the Service will be available at all times or that it will be error-free.
To the maximum extent permitted by law, Albumus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
You agree to indemnify and hold harmless Albumus, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.
Albumus reserves the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
